Dear Mr. Cesario:
As I explained on the telephone last week, your October 5, 1998 letter arrived when I was out of town presenting a paper at a professional meeting. Therefore, I appreciate your extension of time, until October 25, 1998, for the submission of my preliminary response to Mr. Wilson's allegations.
Initially, it must be mentioned that a General Counsel at an institution of higher education wears numerous hats. While my title discloses my primary responsibilities, I often wear the mantle of "administrator." Indeed, my involvement in Mr. Wilson's case was more as an administrator than as an attorney. However, I am mindful that attorneys should be held to the highest ethical and professional standard, regardless of whether they are acting in a legal or other capacity.
I feel somewhat constrained in providing this response inasmuch as the federal Family Educational Right. and Privacy Act of 1974 prohibits the disclosure of student information without a release from the student. Therefore, without his prior written consent I cannot send you a copy of my entire file on Mr. Wilson's claims against various parties at the University. I believe that at least some of the material is germane, if for no other reason than it underlines Mr. Wilson's attitude about the University and, more specifically, those who might have refused to agree with him from time-to-time.
